By accessing this website, scheduling an appointment, or participating in a Remote Online Notarization session, you agree to be bound by these Terms.

1. Nature of Services

eNotaryRemote provides Remote Online Notarization services performed by state-commissioned notaries in accordance with the laws of their respective commissioning states.

We are not a law firm and do not provide legal advice. Nothing on this website, in communications, or during a notarization session constitutes legal advice or legal representation.

You are solely responsible for determining whether your document is appropriate for notarization and whether it will be accepted by the intended recipient. If you have legal questions regarding your document, you should consult an attorney prior to notarization.

2. Identity Verification Requirements

Remote Online Notarization requires identity verification in accordance with applicable law.

Depending on statutory requirements, users may be required to complete one or more of the following:

  • Knowledge-Based Authentication (KBA)
  • Credential analysis of government-issued identification
  • Biometric facial comparison (where authorized)
  • Live audio-video identity confirmation conducted by the commissioned notary

Failure to successfully complete required identity verification procedures may result in cancellation or rescheduling of the session.

The commissioned notary has sole discretion to determine whether satisfactory evidence of identity has been established.

3. Recording & Audit Trail Disclosure

Remote Online Notarization sessions are audio-video recorded as required by applicable state law.

By participating in a session, you acknowledge and consent to:

  • Audio-video recording of the notarization session
  • Creation of a digital audit trail
  • Retention of notarial journal entries and recordings in accordance with statutory requirements

Recordings and electronic records are maintained for the legally required retention period under the laws of the commissioning state.

4. User Responsibilities

By using our services, you agree to:

  • Provide accurate, complete, and truthful information
  • Present a valid, unexpired government-issued photo identification
  • Ensure access to required technology (camera, microphone, stable internet connection)
  • Participate from a private and interruption-free environment
  • Confirm that you are signing voluntarily and possess legal capacity to do so

You are responsible for confirming that your document will be accepted by the receiving party prior to notarization.

5. No Guarantee of Document Acceptance

A notarization verifies identity and acknowledgment in accordance with law. It does not validate the contents, legality, or enforceability of the underlying document.

eNotaryRemote does not guarantee that any document will be accepted by courts, government agencies, financial institutions, or other third parties.

6. Limitation of Liability

To the maximum extent permitted by law:

eNotaryRemote shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use of our services.

We are not responsible for:

  • Technical interruptions
  • Internet connectivity issues
  • Failed identity verification attempts
  • Session delays
  • Rejection of documents by third parties

Our total liability, if any, shall not exceed the amount paid for the notarization service giving rise to the claim.

Nothing in these Terms limits liability where such limitation is prohibited by law.

7. Third-Party Technology Platforms

Remote notarizations are conducted using secure third-party Remote Online Notarization technology platforms.

These platforms maintain independent privacy policies and security practices governing their systems. By using our services, you acknowledge that such platforms are necessary to facilitate the notarization session.

8. Scheduling & Refusal of Service

Appointments may require completion of identity verification steps prior to the scheduled session.

We reserve the right to decline or discontinue service if:

  • Legal requirements are not satisfied
  • Identity cannot be properly verified
  • Required documentation is incomplete
  • Fraud or misrepresentation is suspected

Failure to complete required steps may result in rescheduling or cancellation.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado and applicable federal law, without regard to conflict-of-law principles.

Remote notarizations are performed in accordance with the laws of the commissioning state of the notary conducting the notarization.

10. Modifications to Terms

We reserve the right to update or modify these Terms at any time.

Updated Terms will be posted on this page with a revised Effective Date. Continued use of the website or services after changes are posted constitutes acceptance of the updated Terms.
